Terms of Service

Welcome to ChicChac.

This document constitutes an electronic record in accordance with the provisions of the Information Technology Act, 2000, and the applicable rules framed thereunder, including the rules requiring publication of the terms of use, privacy policy, and other policies for access to or use of an intermediary or digital platform. This electronic record is generated by a computer system and does not require any physical or digital signatures.

These Terms of Use govern your access to and use of the ChicChac website including any content, features, services, and tools made available thereon (collectively, the “Platform”).

For the purposes of these Terms, the expressions “We” “Us” and “Our” refer to ChicChac. The expressions “You”, “Your”, or “User” shall mean any natural person or legal entity who accesses, browses, registers on, purchases from, or otherwise uses the Platform in any manner. Where the User is a minor or otherwise not competent to contract under applicable law, such use shall be deemed to be through a parent, guardian, or other person legally competent to contract, who shall be bound by these Terms on behalf of such User.

By accessing, browsing, registering on, or using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use, together with all other policies, guidelines, notices, and conditions that may be published on the Platform from time to time, including without limitation the Privacy Policy, Exchange & Return Policy, and any other policy deemed to be incorporated herein by reference. These Terms constitute a legally binding agreement between you and ChicChac.

Your use of specific services, features, or functionalities available on the Platform may be subject to additional terms, conditions, disclaimers, guidelines, or policies, which shall be deemed to form an integral part of these Terms of Use. In the event of any conflict between these Terms and any specific service-related terms, the specific terms shall prevail to the extent of such conflict.

ChicChac reserves the right, at its sole and absolute discretion, to amend, modify, update, replace, or remove any part of these Terms of Use or any policy incorporated herein, at any time and without prior notice, to the extent permitted under applicable law. It is your responsibility to review these Terms periodically for any changes. Your continued access to or use of the Platform following the publication of any modifications shall constitute your acceptance of such revised Terms.

Subject to your compliance with these Terms of Use, ChicChac grants you a limited, personal, non-exclusive, non-transferable, revocable permission to access and use the Platform solely for lawful purposes and in accordance with these Terms. No right, title, or interest in or to the Platform or any content thereon is transferred to you, except for the limited right of use expressly granted herein.

If you do not agree with these Terms of Use or any policy incorporated by reference, you must refrain from accessing or using the Platform.

1. Account Registration & Security

Certain features may require you to create an account. You are responsible for safeguarding your username, password, OTP access, and any linked device credentials. All actions carried out through your account are deemed to have been authorized by you unless you notify us promptly of unauthorized activity. We may suspend or terminate access where we reasonably suspect misuse, fraud, identity manipulation, or breach of these Terms.

2. Product Listing & Description

ChicChac endeavours to ensure that all products displayed on the Platform are described and presented as accurately as reasonably possible. However, actual product colours, texture, finish, dimensions, fit, and overall appearance may vary from how they appear on the Platform due to factors including, without limitation, individual device display settings, screen resolution, lighting conditions, photographic limitations, and inherent manufacturing or material variations. All product images, photographs, styling visuals, and model displays are provided for illustrative and reference purposes only and may not always reflect the exact appearance, scale, or detailing of the product delivered. Accordingly, minor variations shall not be construed as defects or misrepresentation. Further, all products displayed on the Platform are subject to availability, stock limitations, warehouse serviceability, and technical or system updates. The inclusion of any product on the Platform does not guarantee its continued availability for purchase or delivery.

3. Pricing & Other Charges

All prices are displayed in Indian Rupees unless stated otherwise. Applicable taxes, delivery charges, convenience charges, COD charges, or promotional deductions will be reflected at checkout, as relevant. We reserve the right to correct typographical or system errors affecting price or description and may cancel orders impacted by such errors. If any payment has already been collected for a cancelled order, the corresponding amount will be refunded in accordance with our refund process.

4. Order Placement & Acceptance

Placing an order constitutes an offer by you to purchase products from ChicChac. Order acknowledgement, invoice generation, or status updates do not by themselves amount to final acceptance. We reserve the right to accept, decline, or cancel an order for reasons including stock unavailability, suspected fraud, unusual order pattern, delivery limitations, pricing error, or inability to verify payment or identity.

5. Payments

Payments may be processed through banks, payment gateways, UPI providers, wallets, cards, net banking, cash-on-delivery arrangements, or other authorized channels made available on the platform. Your transaction may additionally be governed by the terms of the relevant payment service provider. ChicChac is not responsible for failure of payment caused by your bank, processor, network issue, timeout, insufficient balance, or third-party system interruption.

6. Delivery & Fulfilment

Delivery timelines shown on the platform are indicative and may vary based on pin code serviceability, weather conditions, courier operations, stock transfer requirements, public holidays, force majeure events, or verification delays. You are responsible for providing a complete and accurate delivery address and being available to receive the shipment. Risk in the product shall ordinarily pass upon delivery at the designated address, subject to applicable consumer law.

7. Acceptable Use

You agree not to use the platform for unlawful, abusive, fraudulent, defamatory, harmful, or disruptive conduct. Without limitation, you must not introduce malware, use bots or scrapers without permission, place fake orders, interfere with the platform's security or functionality, manipulate reviews, infringe third-party rights, or attempt to reverse engineer the platform except as expressly permitted by law.

8. Third-Party Services and Links

Platform may integrate with or contain links to third-party websites, gateways, logistics providers, social-media tools, or embedded services. We do not control those third-party services and are not responsible for their content, security, policies, or performance. Your interaction with such third parties may be governed by their own terms. Purchases made through third-party marketplaces or external platforms, the applicable terms, policies, and customer processes of such marketplace or platform shall apply, and we shall not be held responsible or liable for any act, omission, deficiency of service, return, refund, cancellation, exchange, delivery issue, or customer support matter arising therefrom.

9. Disclaimer of Warranties

To the extent permitted by law, the platform and all related services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted operation, complete accuracy of all content at all times, or that the platform will always be free from bugs, vulnerabilities, or service interruptions. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.

10. Limitation of Liability

ChicChac shall not be liable for any indirect, incidental, special, consequential, punitive, or other similar damages, including any loss of profits, revenue, data, goodwill, or business opportunity, arising from or in connection with your use of, inability to use, or reliance upon the Platform, products, or services. This includes, without limitation, any liability arising from unauthorized access to or alteration of user data or transmissions, any breach of condition, representation, or warranty by a product manufacturer or third party, any interruption or non-availability of the Platform during maintenance or due to technical issues, and any damage or loss resulting from material or data downloaded through the Platform. Any content or data obtained through the Platform is accessed at your own discretion and risk, and you shall be solely responsible for any resulting damage to your device or loss of data. To the extent permitted by law, our total liability shall in no event exceed the purchase value of the relevant product giving rise to the claim. ChicChac shall not be responsible for disputes arising solely between users or with third parties.

11. Indemnity

You agree to indemnify, defend, and hold harmless ChicChac, its owners, employees, agents, and representatives from and against any claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising out of or relating to your use or misuse of the Platform, breach of these Terms, violation of applicable law, or infringement of any third-party rights. This indemnity shall survive the termination or suspension of your account and your use of the Platform.

12. Suspension and Termination

ChicChac may, at its sole and reasonable discretion, suspend, restrict, or permanently terminate your account or access to the Platform, with or without prior notice, if it believes that you have breached these Terms, engaged in fraud, misuse, abuse, or suspicious activity, created risk to the Platform or other users, or where such action is required for legal, security, technical, or operational reasons.

To maintain a secure and reliable user experience, ChicChac may monitor account and transaction activity. Where irregular, abusive, or suspicious patterns are detected, ChicChac may take appropriate action, including restricting certain features, limiting payment options, suspending order access, cancelling transactions, or imposing other necessary safeguards. Such measures may be implemented without prior notice, subject to applicable law.

13. Force Majeure

ChicChac shall not be liable for any delay, interruption, deficiency, or failure in the performance of its obligations under these Terms, where such delay or failure arises from any cause beyond its reasonable control, including, without limitation, acts of God, natural calamities, floods, fires, epidemics, pandemics, strikes, lockouts, labour disputes, governmental actions or restrictions, judicial or regulatory orders, failure of internet or telecommunication services, cyber incidents, power outages, supply chain disruptions, transportation delays, war, invasion, armed conflict, civil unrest, riots, insurrection, or failure of courier, logistics, or delivery networks. In the occurrence of any such event, ChicChac's obligations shall remain suspended for the duration of the force majeure event, and ChicChac shall not be held responsible for any loss, damage, cost, or inconvenience suffered by the user as a result thereof, except to the extent otherwise required under applicable law.

14. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India. Subject to rights available to consumers under applicable law, disputes shall be subject to the exclusive jurisdiction of the competent courts at Gurugram, Haryana.

15. Customer Support and Grievance Redressal

Users may contact us through the contact details published on the Platform for any complaint, grievance, concern, or request relating to orders, payments, refunds, returns, exchanges, account access, or use of the Platform.

ChicChac shall maintain an adequate grievance redressal mechanism and shall endeavor to redress such complaints within one (1) month from the date of receipt, or within such shorter or longer timeline as may be required under applicable law.

16. Changes to the Terms

We may update these Terms from time to time to reflect changes in our operations, applicable law, or technology. Any revised version will be posted on the platform with an updated “Last Revised” date. To the extent permitted by applicable law, your continued use of the platform after the revised Terms are posted constitutes your acceptance of those revised Terms.

17. Fraud & Scam Awareness

ChicChac never contacts customers to request advance payments, extra charges, or any financial transaction after an order has been placed. Please exercise caution and do not engage with any such fraudulent calls, messages, or phishing attempts. If you encounter such activity, you are advised to immediately report the incident to the National Cyber Cell (Helpline: 1930) or lodge a complaint at https://cybercrime.gov.in/Webform/Helpline.aspx. Once a complaint is registered, you may also reach out to us at our email with your complaint reference number to help us serve you better.

18. Entire Agreement and Severability

These Terms, together with the Privacy Policy and any incorporated policy documents, form the complete agreement between you and ChicChac in relation to the platform. If any provision is found unenforceable, the remaining provisions shall continue to the fullest extent permitted by law.
